SVERAK's feed hosting conditions

Terms - Rights and Obligations 

General 

  1. The owner undertakes to allow the cat to remain in the care of the feed host during the validity of this agreement as long as the points of this agreement are fulfilled. 

  2. The owner undertakes not to assign rights under this agreement to anyone other than the feed host. 

  3. The feed host undertakes to feed and care for the cat and possibly kittens born to the foster host during the time until the final transfer of ownership under this agreement. 

  4. The feed host is obliged to keep the cat available to the owner and to care for the cat in such a way that the owner can use the cat for breeding and/or exhibition rights according to this agreement.

Avel 

  1. The owner undertakes to notify the feed owner in good time within which time frame the owner wishes to dispose of the cat for mating. 

  2. The feed owner must immediately notify the owner when the cat is sexually mature and/or starts running, as well as if the cat's fertile behavior means a sanitary nuisance 

  3. The owner disposes of the cat in connection with mating for as long as is necessary for mating to take place. If the time exceeds 14 days, the owner must specifically inform the feed valuer about this. 

  4. Mating is provided by the owner. If mating is to take place in the forager's home, this must be agreed in writing between the parties before each mating. 

  5. The starting point is that the litter is born at the feed host. If the litter is to be born with someone other than the feed provider, this must be agreed in writing before each litter. If the cat is to have a litter in the owner's care, the owner has the right to dispose of the cat at least 14 days, but no more than 30 days, before the estimated birth of the kittens and at least 12 weeks but no more than 14 weeks after the birth. After that, the female cat returns to the care of the feed owner. 

  6. SVERAK can, if the parties agree to this, grant a dispensation for additional litters, however, at the earliest after the conditions regarding the number of litters in this agreement have been met. This agreement must be attached to such application. 

  7. The feed host does not have the right to castrate the cat without the owner's written approval. If castration is to take place before ownership passes to the fodder value, this must be stated on page 1. Castration must be paid for by the owner. 

  8. The feed host does not have the right to let the cat mate with another cat without the owner's approval. 

  9. The feed host must notify the owner as soon as possible of litters born with him. Visits by the owner and kitten speculators are agreed upon in consultation between owner and feed host. 

  10. The owner disposes of the cat and possibly kittens born at the feed host the time necessary to perform the necessary veterinary examinations and treatments. 

Costs 

  1. All costs that can be attributed to breeding, including additional costs for feed, sand, etc. at litter, are paid by the owner.

  2. Costs for feed, sand, etc., for the cat's everyday needs, are paid for by the owner of the feed. 

  3. The owner is responsible for the cost of breeding insurance as well as 

insurance for kittens. In this agreement, the parties may decide who will be the responsible policyholder. In the event that life insurance fails, the insurance compensation shall accrue to the policyholder. 

  1. The party with whom the cat is staying is responsible for the cat during the time the cat is in its care. The cost (deductible) that is not covered by the insurance must be paid by the person in whose care the cat stays if it becomes ill/injured/deceases. In the case of breeding-related care (mating, breeding, kittens, etc.), the deductible is paid by the owner. 

  2. If either party changes their place of residence and this results in increased transport costs, the person who changed their place of residence must bear the increased transport costs. 

Exhibition 

  1. In the case of exhibition rights, the owner has the right to dispose of the cat for as long as is required for each individual exhibition. If the time exceeds 5 days, the owner must specifically inform the feed valuer about this. 

  2. The owner decides on each occasion whether the feed host is allowed to exhibit the cat. The party wishing to exhibit the cat is responsible for exhibition costs. 

Dispute and termination of the agreement 

  1. If the cat turns out to have a disease or defect that does not allow breeding or further breeding, or if the cat is castrated for veterinary reasons, the feed host agreement for breeding rights ends. If the owner does not wish to use the exhibition rights according to this agreement, the cat passes into the owner's possession without compensation to the owner. 

  2. If the owner wishes to take the cat back and the parties agree on this, the owner must pay compensation to the feed value of half the sales value. If the feed host is given the right to buy out the cat, the price must be determined as a percentage in relation to the number of litters the cat received in the feed host's care, compared to the agreed number of litters. Starting price for calculation is sales value stated on page 1. 

  3. If the feed host cannot or does not want to keep the cat, the owner is obliged to take the cat back within 30 days at the latest - neither party shall then have to replace the other party. 

  4. If the cat has to be euthanized under the foster host's care, the foster host must discuss this with the owner, if this is practically possible. In case of euthanasia, a veterinarian must be called in and the cause of death must be documented by the veterinarian. If life insurance compensation accrues to the owner, the feed value must be reimbursed according to conditions for repossession in point 23. 

  5. The owner has the right to cancel the agreement and, without compensation to the feed host, get the cat back if it is proven that the feed host acts in violation of this agreement. 

  6. This Agreement may not be transferred by sale, gift or testamentary disposition. The agreement cannot be made the subject of property division either. 

  7. If any party to this agreement dies, the agreement expires in its entirety and cannot be enforced by the deceased's rights holder. If the owner dies, ownership of the cat passes to the feed owner. 

  8. Disputes between the parties concerning this agreement or any other agreement or document reached with the support of this agreement must be resolved in the first instance in a Swedish general court. 

When the terms of this agreement are met, all documents belonging to the cat must be handed over to the feed owner, at the same time as a transfer agreement is drawn up. No later than 30 days after the transfer, a certificate of change of ownership must be submitted to SVERAK's office.
